‘Action of contempt of court should be run against Nishikant Dubey’ application given to Attorney General

A petition has been given to the Attorney General, demanding the contempt of court against Bharatiya Janata Party MP Nishikant Dubey from Godda in Jharkhand. An Advocate-on-Cord of the Supreme Court has written a letter to the Attorney General (AG) seeking permission to start ‘contempt proceedings’. According to the law, the contempt proceedings of the Supreme Court against a person can be initiated against a person under Section 15 (B) of the Contemplation of Court Act, 1971 only when the Attorney General or Solicitor General allows it.

Significantly, the BJP on Saturday separated themselves from the sharp comments made by their MPs Nishikant Dubey and Dinesh Sharma on the Supreme Court and the Chief Justice of India Sanjeev Khanna. Party President JP Nadda rejected these comments as personal views of MPs. Nadda said in a post on ‘X’, “BJP has nothing to do with the comments made on the judiciary and Chief Justice of his MPs Nishikant Dubey and Dinesh Sharma.” These are his personal comments, but the BJP neither agree with him nor supports such comments. The BJP rejects them completely. ”

Nadda also said that he has instructed both leaders and others not to make such comments. He said that the BJP has always respected the judiciary and has gladly accepted its suggestions and orders because as a party, it believes that all the courts including the apex court are an integral part of democracy.

The BJP president said, “He is a strong pillar of protecting the constitution.” Dubey, who is representing his parliamentary constituency for the fourth time in the Lok Sabha, is one of the most vocal members of the party in the lower house. Targeting the Supreme Court, Dubey had earlier said that if the apex court has to enact a law, then Parliament and the state assemblies should be closed. He also took a sarcasm at Chief Justice Khanna. Former Deputy Chief Minister of Uttar Pradesh, Sharma also criticized the Supreme Court and said that no one can give instructions to the Parliament or the President.
