The Supreme Court has expressed strict resentment by the Haryana Police for handcuffing the accused and tying it to the hospital bed. The Supreme Court has directed the Haryana government to issue guidelines to the police. The Supreme Court has said that the fundamental right to live with respect was compromised under Article 21 of the Constitution.
In fact, the Supreme Court has declared the arrest illegal due to the police not informed about the cause of the arrest. Along with this, the Supreme Court also surprised the behavior of the Haryana Police that the person was handcuffed and tied with chains on the hospital bed.
A bench of the Supreme Court, led by Justice Abhay S Oak, ordered the state of Haryana to issue guidelines to prevent such actions and to ensure strict compliance of Article 22 and said that if necessary, the rules amendment also if necessary Be done
Criticizing the behavior of the police with the appellant, the court said that its fundamental right to live with respect under Article 21 of the Constitution was compromised. The bench said, – “Before ending this decision, we should mention the shocking behavior done by the police to the appellant. He was taken to the hospital with handcuffs and tied to the hospital bed with chains. This in itself is a violation of the fundamental right of the appellant under Article 21 of the Constitution of India. The right to live with respect is a part of guaranteed rights under Article 21. Therefore, we propose to issue the necessary instructions to ensure that such illegalness is never done. Haryana will issue guidelines/departmental instructions to the state police (i) To ensure that the work of handcuffing an accused on the hospital bed and tying it to the hospital bed is not again. (ii) To ensure that constitutional security measures under Article 22 are strictly followed, if necessary, the state government will amend the existing rules/guidelines.
