The Supreme Court on Friday sought a response from the governments of Maharashtra and Assam on the petition of YouTuber Ashish Chanchalani, in which the recent online program “India’s Got Latant” was recorded in Guwahati for allegedly promoting pornography in the recently aired link to “India’s Got Latant”. The FIR has been requested to cancel or move to Mumbai. The bench of Kotishwar Singh stated the petition of Chanchalani with a pending petition of Podcaster Ranveer Allahabadia.
The FIR lodged in Assam includes Chanchalani’s name. Allahabadia has been allegedly described as the main accused in this FIR regarding the controversial remarks in the YouTube program organized by the comedian time Raina.
During the hearing, the bench told senior advocate Ajay Tiwari, appearing for Chanchalani, that he had already been granted bail in this case.
- Tiwari and Advocate Shubham Kulshrestha agreed with the bench but argued that he was against registering several FIRs regarding the same program.
- The bench said that it is already hearing the issue and Chanchalani’s petition is linked to the petitions.
- On February 18, the Supreme Court gave Allahabadia interim protection from arrest for his comments. The court termed his comments as ‘obscene’ and said that his ‘thinking is dirty’, which embarrasses the society.
- Several FIRs were lodged against Allahabadia, popularly known as ‘Beerbieceps’, for commenting on parents and sex on Raina’s YouTube program “India’s Got Latant”.
In his petition filed by advocate Shubham Kulshrestha and filed by advocate Manju Jaitley, Chanchalani has requested to cancel the FIR lodged in Cyber Police Station, Police Commissionerate, Guwahati Crime Branch, Assam.
The petition requested, “Call the FIR number … lodged in Cyber Police Police Commissionerate, Guwahati Crime Branch, Assam as it was later recorded.”
The Guwahati High Court, while hearing the anticipatory bail plea of Chanchalan on 18 February, granted him interim bail and asked him to appear before the investigating officer within 10 days.
Chanchalani’s lawyer argued that his client did not say anything in the program and the allegations in the FIR were made against the co-accused persons only.
On February 10, the Guwahati police registered an FIR under various sections of the Indian Justice Committee (BNS), Information Technology Act, Cinematographs Act and Women’s Pornography (Prohibition) Act on the complaint of a person.
