SC reprimanded Tamil Nadu Pollution Control Board on Isha Foundation case, what is the matter

The Supreme Court hearing on the petition related to Isha Foundation.

New Delhi:
The Supreme Court today heard a petition related to not taking environmental clearance in the construction of Isha Foundation in Coimbatore, Sadguru Vasudev Jaggi. This petition was filed by the Tamil Nadu Pollution Control Board. During this time, the Supreme Court reprimanded the Tamil Nadu Pollution Control Board and asked why he did not remember the approval for so many days. Now it has become a yoga center, so why are these questions now raising the question.

“Who stopped going to SC on time?”

Justice Suryakant told the Tamil Nadu Pollution Board who had stopped you from going to SC on time. How will the stay given by Kerala HC take away the jurisdiction of another court? On the request to file a better affidavit, Justice Suryakant said that if we start accepting better affidavits and accept the delay of more than 633 days, then why should the poor litigants be denied it. Why should only the rich litigants be heard and where will the general plaintiff go.

  • How do you say that Yoga Center is not an educational institution?
  • How can we accept a delay of 633 days?
  • If we do this, we will set an example
  • It will seem that we are giving special treatment to rich litigants
  • Now that the yoga center has been built, you are not saying that it is dangerous
  • Now your concern should be to ensure that all environmental parameters are followed
  • Sunlight, greenery, raise those issues
  • It is mandatory for everyone to follow it

Madras HC’s decision challenge in SC

The Supreme Court heard the petition of the Tamil Nadu Pollution Control Board in which the Madras HC’s 2020 decision has been challenged in which Isha Foundation is “to” construction work in Coimbatore (2006-2014) to do “without compulsory environmental clearance” The show cause notice was canceled. The notice issued by the Madras High Court for not taking approval from the Environment Department during construction between 2006 and 2014 was canceled by the Madras High Court. The decision of the High Court has been challenged by the Tamil Nadu government in the Supreme Court.

What did Isha Foundation say in court?

The Supreme Court asked the state government, how can you say that the Yoga Center is not an educational institution? If you are not running according to the rule, then you can take action against it. On this basis you cannot be allowed to demolish that construction. Isha Foundation lawyer Mukul Rohatgi told the court that we have environmental approval. Only 20% of the construction is done here, 80% of the green area and it is one of the best centers in India. The Supreme Court will now hear the matter after three weeks.
