US Supreme Court will hear a new petition on Tahwwur Rana’s new petition on extradition

New York:
The US Supreme Court Judge will hear the new petition of Tawwur Rana, accused of the Mumbai terror attack, in which he has requested to stop the process of extradite India. The new petition has been filed before ‘Chief Justice’ John Roberts. Rana (64), a Canadian citizen of Pakistani origin, is closed in Los Angeles’s ‘Metropolitan Detention Center’. He has been a close associate of David Coleman Headley, one of the main conspirators of the attack on 26 November 2008 in Mumbai.

Rana had submitted before Elena Kagan, ‘Circuit Justice’ of the ‘Associate Justice’ and ‘Ninth Circuit’ of the US Supreme Court, ‘Emergency application to stop the pending trial of the prisoner petition’ before Elena Kagan. Earlier this month, Kagan rejected the application.

Hearing on application will be held on 4 April

Rana then renewed his emergency application to stop the pending trial of the “habeas corpus petition” first appeared before Justice Kagan and requested it to be produced before ‘Chief Justice’ Roberts. An order published on the Supreme Court website states that the date of April 4, 2025 has been fixed for hearing Rana’s renewed application and “application” has been sent to the court. “

Eminent Indian-American lawyer Ravi Batra of New York told ‘PTI’ that Rana had applied to the Supreme Court to stop extradition. This application was rejected by Justice Kagan on 6 March. He said that this application is now in front of ‘Chief Justice’ Roberts, “who has shared it with the court to use the entire court outlook.”

Batra said that he sincerely hopes that “Chief Justice Roberts will decide to deprive Rana from the right to stay in the US and to avoid justice in India.” He said, “After meeting at the Oval of US President Donald Trump and Prime Minister (Narendra) Modi, President Trump announced at the Correspondent Conference that Rana would be given the transit.”

In his emergency application, Rana had requested to stop the sovereignty and his extradition on his February 13 petition on the basis of merit and deception. In that petition, Rana argued that his extradited India is a violation of the ‘United Nations Convention’ against the US law and torture, “Because it is a sufficient basis to believe that the petitioner would be in danger of torture if he was extradited to India.”

The petition said, “The possibility of harassment in this case is even more as the petitioner is a Muslim of Pakistani origin in the Mumbai attacks.” The petition also states that extraditing him in Indian custody centers due to his ‘serious medical status’ is also ‘really’ death sentence.
