According to this order, even if the parents of a child are not American citizens and the child is born in America, he will not be given citizenship.

His father should not be an American citizen or legally living in America.

Donald Trump, who took oath as the new President of America, believes that illegal immigrants have misused the provision of citizenship by birth to a child in America. This is why Trump’s executive order directly targets the 14th Amendment of the US Constitution. Trump is very angry not only with illegal immigrants but also with this law.
In his executive order, Trump has also said that he will interpret the 14th Amendment differently than before. He also argued that it has never been interpreted to extend citizenship to all people born in the United States.
What does American law say?
According to the 14th Amendment of the US Constitution, people born in America or naturalized here will be considered citizens of America and the state where they live. This amendment was made in 1868 to eliminate many injustices which came after an 1857 decision of the US Supreme Court. That decision prohibited the citizenship of children of black slaves, but this injustice was ended by the law of 1868.
In 1898, the US Supreme Court gave a historic decision under this law, granting citizenship to the San Francisco-born son of a Chinese immigrant couple. The Supreme Court said that children born on American soil to a non-citizen couple will be considered American citizens.

The US Supreme Court’s interpretation of the Fourteenth Amendment still stands. However, Trump and his supporters are completely against it and Trump said in his order that this amendment did not mean that every person born in America should be given citizenship. He also emphasizes this time that children born in America to undocumented couples living in America will not be given automatic citizenship. Trump’s order will ensure that those children born in America will not automatically be considered citizens of America whose at least one parent is not a legal citizen of America, that is, one of the parents is an American.
