Nainital:
The Uniform Civil Code (UCC) came into force in Uttarakhand on 27 January. UCC is the first state in the country to implement UCC in Uttarakhand. But there has been a big debate on many of its provisions. There are many people who do not consider compulsory registration of live-in relationship to be correct. He says that this is a violation of privacy. The specific provisions of the UCC, especially the necessary registration of live-in relationship, have been challenged in the Uttarakhand High Court. Hearing another writ petition filed by a 23-year-old man, the High Court said that the state is not banning the live-in relationship, but is only providing his registration.
“Gosip will get a boost”
Abhijay Negi, a lawyer of the petitioner (Jai Tripathi) in front of the bench of Justice Alok Mahra, argued that under the UCC, the state is promoting the state Gossip by making necessary provisions for registration of such relationships. Citing the Supreme Court’s decision of 2017, he insisted on the right to privacy, arguing that his client’s privacy is being violated, as he announced his live-in relationship with his partner or not registration. Want to do
However, the bench denied his argument and said that there is no provision for any such announcement in the UCC. There is only a provision for registration for relationships like live-in relationship.
“You live together, everyone knows, then what kind of secret”
The Chief Justice of the Uttarakhand High Court said that both of you are living together, this thing knows your neighbor, society and the world. Then which secret are you talking about. He asked if you are living in an ankant cave in a secret manner. You are living among a civilized society, without marriage you are living together. What is such a privacy that is being violated.
During the debate on the matter, the petitioner’s counsel referred to the incident in Almora district in which a young boy was killed because he was living in an inter-religious live-in relationship. On this, the Chief Justice said that some work should be done to make people aware. He said that if the matter is associated with other petitions challenging the UCC and if forced action is taken against anyone, then that person can come to court.
Challenging provision related to live-in relationship
Explain that two other petitions challenging UCC are pending in Uttarakhand High Court. Many provisions of the Uniform Civil Code (UCC) have been challenged in the PIL. This includes provisions especially related to live-in relationship. While another PIL by Aarushi Gupta challenged the provisions related to marriage, divorce and live-in relationship, arguing that they are violating the fundamental rights of citizens.
