In this case, Prashant Kishore had already got bail from the court. The court had ordered bail on a personal bond of Rs 25,000. The court had put a condition along with the bail bond that he cannot participate in such protests which may lead to disruption of law and order. However, Prashant Kishore refused to pay the bail bond and accept the bail conditions, after which he was sent to judicial custody.

On behalf of Prashant Kishor, it was said that protesting is his fundamental right. He demanded the court to remove the condition, which was rejected by the judge.
