According to the court proceedings, Ahmed’s counsel, A.M. Bora, submitted that the incident was “a pure accident” and argued that there was no criminal intention on the part of the petitioner.

“This Court is of the opinion that applicability of Section 105 of the BNS, 2023 in the said case is doubtful,” the court order granting bail to Ahmed stated.

While pronouncing the order, the High Court further observed that Ahmed did not deserve to remain in custody for any further period.

The accident had taken place in the early hours of April 26 at around 4 AM in the Mathgharia area of Guwahati. The car driven by Ahmed reportedly rammed into a parked truck.

The victims were identified as Puja Saha (26) from Goalpara, Akanksha Saikia (23) from Sivasagar, and Armina Ahmed. While two of the women died on the spot, the third later succumbed to her injuries at a hospital.
