Overqualified Candidates Cannot Claim Jobs Meant for Lower Qualifications, Says Supreme Court


 

GUWAHATI: The Supreme Court has ruled that candidates who conceal their higher educational qualifications while applying for posts meant exclusively for individuals with lower qualifications cannot claim protection under law, emphasizing that such actions undermine the integrity of the recruitment process.

A bench comprising Justices Ahsanuddin Amanullah and R. Mahadevan observed that permitting overqualified candidates to secure positions reserved for less-qualified applicants would be unfair to those who genuinely meet the prescribed eligibility criteria. The court noted that such appointments defeat the very purpose for which the posts are created.

Referring to its earlier decision in Jomon K.K. v. Shajimon P. and Others (2025), the apex court reiterated that public employment must be governed strictly by the qualifications and conditions laid down in recruitment rules.

The bench clarified that merely possessing educational qualifications higher than those prescribed for a post does not confer an automatic right to appointment. Recruitment authorities, the court said, are fully entitled to enforce eligibility requirements and ensure that vacancies are filled only by candidates who satisfy the stipulated criteria.

Allowing the appeal, the Supreme Court upheld the employer’s decision to terminate the respondent from service, holding that the action was legally valid and in accordance with the applicable recruitment norms.
