Arvind Kejriwal Refuses to Appear Before Delhi HC Judge, Cites ‘Loss of Faith’ in Excise Policy Case


 

GUWAHATI: Former Delhi Chief Minister Arvind Kejriwal, on Monday, April 27, informed the Delhi High Court that he will not appear in proceedings before Justice Swarana Kanta Sharma in a case challenging his acquittal in the Delhi excise policy controversy.

In a letter addressed to the judge, the Aam Aadmi Party (AAP) chief said he had “lost faith” in her ability to ensure a fair hearing. The move follows the court’s recent rejection of Kejriwal’s request seeking Justice Sharma’s recusal from the case.

Kejriwal has alleged a conflict of interest, claiming that the judge’s children—who serve as panel lawyers for the central government—have professional associations with Solicitor General Tushar Mehta, who is representing the opposing side.

Citing Gandhian principles, Kejriwal stated that he would not be able to continue with the case “either in person or through counsel” in Justice Sharma’s court. He added that the decision was guided by his conscience, while indicating that legal options remain open.

“I reserve the right to approach the Supreme Court against Justice Swarana Kanta Sharma’s verdict,” he said.

The development comes shortly after Justice Sharma refused to step aside from the case, dismissing allegations of bias. In a firm statement, she emphasized judicial independence, asserting that her oath to the Constitution requires her to adjudicate matters without fear or external pressure.

“My oath is to the Constitution… justice does not bend under pressure,” she said while declining to recuse herself.
