A division bench comprising Justice Prathiba M Singh and Justice Madhu Jain directed that Khalid be released from June 1 to June 3 on strict conditions, taking what it described as an “empathetic view” of the circumstances.

Khalid had approached the High Court seeking interim bail to attend the Chehlum, a post-death ritual, of his uncle and to take care of his mother, who is scheduled to undergo surgery.

He had sought 15 days’ interim bail from May 22 to June 5 after a trial court on May 19 rejected his plea for temporary release.

Khalid has been in judicial custody since September 2020 in the larger conspiracy case linked to the northeast Delhi riots that broke out in February 2020.

The prosecution has alleged that the violence was part of a pre-planned conspiracy connected to protests against the Citizenship Amendment Act (CAA), charges that Khalid has denied.
